Lindsay Lohan ‘rattled and quite shaken’ after alleged attack by NYC man; both file harassment complaints

New York City police have decided to drop the charges against Christian LaBella, the man Lindsay Lohan is accusing of attacking her on Sunday – but that doesn’t mean that she isn’t still upset over what transpired that early morning in her hotel room. The actress’ mom, Dina, told “Entertainment Tonight” that her oldest daughter “is understandably rattled and quite shaken by what she experienced … I have complete faith they will bring this criminal matter to its rightful conclusion.” That doesn’t seem likely now. Not long after LaBella, a legislative aide for Rep. John Shimkus (R-Ill.), was charged with two counts of misdemeanor assault and two counts of harassment, those charges were dropped by the NYPD after its investigation concluded there had been no assault.

But the case is far from closed. On Monday, it was reported that both Lohan, 26, and LaBella, 25, have filed harassment complaints against each other, stemming from the incident that went down in a room at the W Hotel in Manhattan around 6 a.m. on Sunday. According to original reports, the “Liz & Dick” actress told police that she invited LaBella back to her room after meeting him at a local nightclub, but soon realized he had taken 50 photos and/or videos of her and her friends. When she grabbed his phone and attempted to delete them, Lohan claims the man choked her and threw her on to a bed.

"Cross complaints for harassment were filed and LaBella's assault arrest was voided after detectives investigated further," NYPD Deputy Commissioner Paul Browne told CNN on Monday.

LaBella is certainly no stranger to celebrities. In addition to being the nephew of comedian Heather McDonald, who often appears on E!’s “Chelsea Lately,” he has hobnobbed with the likes of Kim Kardashian, Joe Francis, and vice presidential candidate Paul Ryan, according to LaBella’s Facebook page, which he has since deleted.

His uncle is trying to clear his name in the wake of the bizarre incident. “It’s shameful that a celebrity with a personal publicist can persecute a nice guy like Christian,” Peter Jessop told the New York Daily News. “He’s a decent kid who met her at a nightclub and she invited him back to her hotel room with other people. And now she’s using her celebrity to launch a full-scale witch hunt against him just to be relevant again.”
