It looks like Brooke Mueller may have won the advantage in her ongoing custody war with ex-husband Charlie Sheen -- for now, at least. The former couple's twin sons, Bob and Max, are set to move back into their mom's house six months after they were removed from her care by the L.A. County Department of Child and Family Services, TMZ reports. But there's a catch.

According to TMZ, Brooke's brother Scott Mueller -- not Brooke herself -- was awarded temporary guardianship of the 4-year-old boys on Friday, Nov. 8. Prior to that, the kids were under the care of Sheen's second ex-wife, Denise Richards.

Richards, 42, reportedly told officials recently that she could no longer handle the twins because they were "violent" and a danger to her daughters. (Sheen and the Wild Things actress have two girls, Sam, 9, and Lola, 8; Richards also has an adopted daughter, Eloise, 2.)

Sources told TMZ that the judge who granted guardianship to Scott Mueller felt it was important for Bob and Max to continue their education at the school they've been attending up to this point. And since Scott lives far away, the judge reportedly ruled that he and the boys could move into their mother's L.A.-area house.

Per TMZ, Brooke does not technically have full custody rights of her kids, but they will be living full-time in her home. It's unclear at the moment whether Brooke herself will be there full-time as well.

In any case, this is certainly not the outcome Sheen was hoping for. He and his third ex-wife -- who divorced in May 2011 after three years of marriage and a violent Christmas Day 2009 brawl, among other incidents -- have been at war over the care of their twin sons for months, ever since her residence was deemed an "unsafe environment" back in May. Mueller checked into rehab soon after to get help for prescription drug abuse, and Richards became the temporary guardian for Bob and Max.
