The 37-year-old appeared on "Good Morning America" Thursday and talked about the headline-making joint arrest of her husband, talent agent Jim Toth, (for alleged drunken driving) and herself (for disorderly conduct) nearly two weeks ago in Atlanta, during which the Oscar-wining actress infamously said to police, "Do you know my name?" and "You're about to find out who I am."
“I saw [the police officer] arresting my husband and I literally panicked,” the Oscar-winning actress said in her first post-arrest interview. "I told him I was pregnant. I’m not pregnant. I said all kinds of crazy things. ... I was so disrespectful to him. I have police officers in my family. I work with police officers every day. I know better. It’s just unacceptable.”
The "Legally Blonde" star went on to say she was perhaps channeling some of her characters during the incident, noting,
“I played a lawyer in a movie so many times I think I am a lawyer. And, clearly, I’m not a lawyer because I got arrested. When a police officer tells you to stay in the car, you stay in the car. I learned that for sure."
Witherspoon provided a little more insight into the night of April 19. In Atlanta to film "The Good Lie," she and Toth, 42, were driving in a silver 2013 Ford Focus when he was pulled over at around midnight by a police officer who claimed he was driving erratically. Toth, who allegedly appeared disheveled and smelled of alcohol, blew a .139 on his sobriety test; the legal limit in Georgia is .08.
“We went out to dinner in Atlanta and we had one too many glasses of wine,” said Witherspoon, who also acknowledged that she had been drinking in a statement immediately following the incident. “We thought we were fine to drive and we absolutely were not. We know better and we shouldn’t have done that.
“It’s just completely unacceptable and we are so sorry and embarrassed,” she continued. “I think we made a mistake and it was something that will absolutely never happen again.”
The hardest part of the incident has been explaining it to her children, said Witherspoon, who has two kids from her marriage to Ryan Philippe as well as an infant son with Toth.
“We have to say when you make a mistake, you take responsibility and we are taking responsibility and doing everything in our power to make it right,” she said.
